Increasing Violation on Land Allocation in Bali

The plan to revise land zoning regulation - locally known as Perda RTRW - which so far has not concluded yet after quite a long has brought specific problem to the City Government of Denpasar. Perda RTRW on the provincial level of Bali serves as the main reference of the same regulation in a lower level of regency and city administration. Delaying completion of Perda RTRW of Bali has affected the territory allocation in general. Elaboration of the similar regulation in lower level have been delayed as well.

“Violation on zone alocaion taking place in certain regency / city administrative has been one of the reason of delayed completion of Perda RTRW of Bali. Regencies and city administrative have taken their action whilst the source to be use as their reference remains missing. It has been severely affecting integration efforts,” said the co-chairman of the House of Representatives of Denpasar city I Ketut Suwandhi, S.Sos in his office pm Tuesday (November 18th 2008).

Suwandhi has brought the issue into attention considering elaboration of Perda RTRW of Denpasar is coming to completion. Therefore to ensure disintegration between the coming Perda RTRW of Denpasar and the higher level Perda RTRW of Bali, Suwandhi has pushed Bali Provincial Government to finalize Perda RTRW if the provinvial level. The situation can potentially affect the effort to preserve Bali

Suwandhi continues his briefing by saying that without presence of the reference regulation - which in this case is Perda RTRW Bali - allocation of space in regency and provincial level will me elaborated and implemented on their own. The such constrains is potentially affecting the effort to preserve Bali natural blessings which is the common responsibility of all stakeholders. Suwandhi believes that without provincial level of RTRW to serve as a reference to similar regulation in lower level, the regulation UU No, 32 = 2004 on regional government will be taken as the reference by the government of regencies and administrative cities to enforce their own regulation which in most case stands against the higher provincial level.

“Perda RTRW of Bali has to be completed in expedited manner. The Provicial Government and the House of Representatives of Bali has to do anything it takes to ensure it to happen, otherwise integrated policy between the Provicial government and the lower level Regencies and Administrative Cities will fail to be implemented. Government of regency and administative office will also have strong reference in elaborating their regulations,” said Suwandhi.
Whilst regulation on land alocation zoning - UU No. 26/2007 has motivated the government of regency and administrative cities to elaborate their own regulation by remained referecing to UU No. 26/2007 to. However sychroniztion with similar regulation in higher level offices - has been quite a complication.

Chief of Special Committe for RTRW of Denpasar House of Representatives Ir. I.B. Gede Udiyana informed that elaboration for RTRW for Denpasar is coming to completion.
