Bali Governor, Made Mangku Pastika asserted his rejection against UU No 44 2008 concerning Pornography as for unimplemented the contents of that Bill in Bali.

“Just like Bali government previous statement, this island could not implemented that Bill since the law contradicting the sociologic and philosophic values,” said Pastika.

Pastika said that statement during a dialogue session with Komponen Rakyat Bali (KRB) – Component of Balinese People – who visited his office on Thursday (March 25).

Mahkamah Konstitusi (MK) – Constitutional Court – will decide the result for judicial review toward Pornography Bill proposed by Aliansi Bhineka Tunggal Ika – Bhineka Tunggal Ika Alliance – on Thursday in Jakarta.

KRB who declined the Bill since it discussion in 2006 asked for Bali government resolution as for the governor and Bali council.

“Pornography definition in this Bill is very dangerous. The content could threaten many people. Moreover, women and children in this case are vulnerable criminalized,” said Luh Anggreni, women and children activist in Bali. At least there are 11 people as KRB delegation from varied elements such as young generation, women, law and else.

Pornography mentioned in that law is picture, sketch, illustration, photo, writing, sound, voice, moving picture, animation, cartoon, dialog, body movement, or any other messages through lots of communication media or performance in public, contain of pornographic or sexual exploitation against social norms in society.
This Bill is rejected by group of people, mostly those in East Indonesia who saw this law as an effort to cultural uniformity. Since 2006, hundreds of people demonstrated against the Bill in various regions and at Jakarta itself, as for Bali was driven by KRB.

on February 21st 2006, five Balinese figures, that is Ida Pedanda Sebali Tianyar Arimbawa, I Gusti Ngurah Harta, Prof. Dr. I Made Bandem, Wayan P. Windia as well as Cok Sawitri met with Special Committee of Anti Pornography and Porn action at DPR RI, Senayan, in order to deliver Balinese refusal toward that controversial bill draft.

KRB asked for the special committee of Pornography and Porno action Draft Bill Regulation to stop discussing that Bill. As a solution, KRB suggested that discussion concerning pornography and porno action sharpened through KUHP – Book of Law of Criminality – press Bill, National Film Bill, broadcasting Bill, domestic violence bill, and children protection bill. Though, the Council through special committee could not just stop this process.

Rejection still flowed until today. Bali Governor and head of Bali council had signed a statement letter refuse the law in 2008 and sent it to the president as well as central council.

“Bali is The Island of Peace. We also against pornography crime but this law is not walk side by side with the sociologic values flow within Indonesia cultural diversity,” said Pastika.

Personally, he did not agree with artists produced porno goods such as keychain shaped in term of men genitalia. Still he has no problem with an art drawing the beauty of women body, that kind of art is not too vulgar.

“For years I had duty in Irian and not stimulated seeing koteka. This is a matter of feeling,” he added.
He viewed this Bill, although will be legalized soon, would find difficulties when implemented it in all areas in Indonesia.

“If that Bill is effective then there will be no television show and internet in which those two is close with the porno definition in that bill. But in fact there is exist television show nowadays. The bill is no use,” he said lightly.
