The government considers to imposing criminal and civil sanction simultaneously to company that did not pay attention to environment preservation. Nevertheless, this plan is still under academic and law comprehensive study.
Ministry of Environment, Gusti Muhammad Hatta in the middle of National Seminary about banking role in preserving the environment, in Kuta (July 20) said that simultaneous sanctions imposition for criminal and civil code will be prioritized onto companies that would has two black categories in an assessment program for environmental performance rating.
Gusti Muhammad Hatta stating that simultaneous criminal and civil code sanctions imposition is indispensable, it is when one company convicted by criminal code automatically they have no obligation to conduct environmental improvement.
“We proceed it in civil code first then ask them improve the environment that has been damaged in order to move it further to civil sanction,” said Gusti Muhammad Hatta.
Gusti Muhammad Hatta mentioned there are 627 companies participated in assessment program for environmental performance rating during 2009. It was recorded that 56 companies were under black category. Most of those companies were mining companies.
